First of all, Raghupathi said that Chief Minister M.K.Stalin did not say anything about the caste-wise census conducted in the state of Bihar or the cancellation of it by the Patna High Court. Next, referring to some paragraphs of the Supreme Court judgment in the Vanniyar reservation case, and the information sent by the Tamil Nadu Backward Persons Commission that in the absence of complete caste-wise population data, employment and education-based data alone cannot be taken as reasons for social, educational & economic backwardness, Vanniyar Minister Raghupathi has said that the Tamil Nadu government has come to the position that caste-wise census is required for quota.

As the Law Minister of a state, he is speaking without knowing the features of the Supreme Court judgment and the requirements for reservation, so I would like to give him some very simple explanations.

1. Nowhere in the judgment of the Supreme Court in the Vanniyar reservation case did it say that reservation should be given to the Vanniyars only by conducting a caste-wise census. The term “pertinent, contemporaneous data” mentioned in paragraph 68 of the judgment of the Supreme Court only means “contemporaneous statistics” and not the caste-wise statistics mentioned by the Minister in his report. The Law Minister should first understand this.

2. As the Law Minister mentioned in his statement, “only population has been considered for reservation to Vanniyars. It is true that the Supreme Court has noted that no details of the backwardness and social status of the most backward and backward communities have been examined.

By reading this part of the Supreme Court judgment, one can easily understand that what the judges are asking for is the details of the backwardness of the Vanniyar community. When that is the case, where does the need for caste-wise enumeration to provide Vanniar reservation arise?

3. Demographic details of a particular community should be studied only if reservation is not allotted to any community and new quota is to be allotted or the existing quota is to be increased.

But the Vanniyars did not demand a new reservation; There is no demand for increasing the existing quota. Internal quota is only 20% reservation for most backward classes. To determine this, when the new category of Most Backward Class was created in 1989, the caste-wise population data on which it was based is sufficient. There is no need to conduct a new caste-wise census for that.

4. The Tamil Nadu Commission for Backward Persons is now saying that only if caste-wise census details are available, reservations can be given to Vanniyyas.

5. Why does the Commission for Backward Persons, which is supposed to make recommendations as per the judgment, demand details of caste-wise census when the Supreme Court judgment nowhere mentions the need for caste-wise census to provide reservation to Vanniyyas?

6. If caste-wise enumeration is necessary for granting internal reservation to Vanniyyas, it can be intimated to the Commission within the first week of handing over the work. But why is the backward caste commission demanding a caste-wise survey for the internal reservation of vanniyar after 17 months after keeping silent all that time?

7. Commission for Backward Persons was given mandate on 12.01.2023 to recommend reservation of Vanniyar seats. While the deadline was initially set to submit the report within three months, the deadline for the commission was extended a total of 3 times. The Commission should have communicated the reason to the Government before extending the deadline each time. But the Commission has never once requested the government to conduct a caste-wise census.

8. Only in January last year, the Tamil Nadu government directed the Commission for Backward Persons to recommend the reservation of Vanniyar seats. A month later, the Commission for Backward Persons requested in February 2023 that there was insufficient manpower to analyze the data on Vanniyar reservation and for that purpose, a special officer should be appointed.

Accordingly, a Northern State IAS officer named Haneesh Sabra was appointed to coordinate the data collection. Even then the Commission did not raise the demand for a caste-wise census. On the contrary, when statistics about the backwardness of the Vanniars have been submitted to the commission, why is the commission demanding a caste-wise census now?

9. When 20% reservation was given to 108 castes including Vanniyars in 1989, no caste wise census was conducted for it. It was given on the basis of the figures contained in the Ambasankar Commission report.

Hiding this, Law Minister Raghupathi says that reservation can be given to Vanniyars only if caste-wise census is conducted by the Central Government, which is a big conspiracy against Vanniyars. No reservation should be given to Vanniars; They must remain very backward until the end; It shows that the DMK government thinks that it has to cheat them and buy votes to survive.

All these questions should be answered by the Chief Minister and the Minister. Chief Minister M.K.Stalin and Minister Sivashankar have been contradicting each other regarding Vanniyar reservation. The chief minister says that there is no data on the backwardness of Vanniyars. But the Minister says that the Vanniyyas get more than 10.5% reservation.

That means he has the stats for it. On the one hand the Chief Minister says there are no statistics; But the minister says there are statistics. The figures are sought by the Commission for Backward Persons itself. What is the ban on giving it to the commission and giving reservation to Vanniyar? Chief Minister M. K. Stalin’s claim that the state government has no authority to conduct caste-wise census is a blatant lie.

The Ambasankar Commission report is the basis for implementing 69% reservation in Tamil Nadu today. Will the MGR government’s order in 1980 increasing the quota for backward classes to 50% stand? In 1983-84, the Ambasankar Commission set up as per the order of the Supreme Court conducted a house-to-house survey and submitted a recommendation report containing details such as caste-wise demographics and backwardness.

The Supreme Court accepted it without raising any questions. The Chief Minister says that the state government has no authority to conduct caste-wise census without knowing all these facts. This shows that people around him are deceiving by giving false information. Finally, the BJP has talked about 10.50% reservation only during general elections and by-elections. Law Minister Raghupathi has said that he is cheating.

I pity his ignorance. People like Raghupathi, who got the ministerial post in AIADMK and the ministerial post in DMK wherever they saw green, did not even know the beginning of the social justice struggle being conducted by Ramadoss; Don’t know that either. So, he is repeating the story that someone has written over and over again like a clip.

In a statement during the 2019 Vikravandi by-election, the then leader of opposition M.K.Stalin promised that if we come to power, we will give internal reservation to the Vanniyyas. After that he refuses to open his mouth about it. It is cheating to talk about Vanniyar reservation during the by-elections and then to remain silent. That is DMK’s full-time occupation; It is in DMK’s blood and genes.

Does Minister Raghupathi not know that the DMK is the full-time tenant of the fraud that is deceiving the people by making promises in the 2019 Lok Sabha elections and 2021 Assembly elections and refusing to fulfill them? NEET waiver, education loan waiver, jewelry loan waiver, crop loan waiver, government jobs for 5.5 lakh people, 75% reservation for local youth in private sector jobs in Tamilnadu, reduction in electricity bill, once a month electricity bill survey, reduction in bus fare, old pension scheme for government employees and teachers. The list of scams done by DMK is very long.

Law Minister Raghupathi and DMK have no right to complain about the Patali Makkal Party, which is the epitome of fraud and uncompromisingly fighting for social justice. All that DMK has done to Vanniyars in matters of social justice is betrayal. The only remedy DMK has to do is reservation. He urged that the government should immediately bring and pass the law to provide internal reservation to Vanniyars in education and employment without further delay.
