The Madhya Pradesh High Court has given a decisive verdict that if the wife does not allow the marriage, the husband can get a divorce.
Husband and wife from Madhya Pradesh were living together. In this case, it is said that the wife did not give consent to the marital relationship. It is said that despite the husband’s repeated insistence in this regard, he did not allow it. After this, the husband decided to divorce his wife. And in this regard, he has filed a petition for divorce in the family welfare court in the state. In this case, the court gave a verdict granting divorce to the husband.
Against this, the wife filed an appeal in the Madhya Pradesh State High Court. The High Court heard this petition and confirmed the divorce. The Madhya Pradesh High Court has granted divorce to the husband on the grounds that the wife’s refusal to have matrimonial relations is cruel under the Hindu Marriage Act. The High Court has given this verdict in a case where the husband did not allow the wife to have marital relations.
