The Madurai branch of the High Court has recommended to the Chief Justice of the Madras High Court that appropriate rules should be framed to prevent protracted trials in divorce cases.
The wife had filed a divorce petition against her husband on the ground that he had cheated her by claiming false educational qualifications during the marriage.
In 2014, the wife filed a case in Trichy Family Welfare Court seeking divorce from her husband. A petition was filed by the husband asking that they should be ordered to live together at the time of the conclusion of the case.
The family welfare court heard the case and dismissed the divorce petition. The husband filed an appeal in the Madurai Branch of the High Court challenging the order of the Trichy Family Welfare Court.
The judges have mentioned that there is no time limit for filing a counter-petition in a divorce case.
