In the past few years, the enforcement department’s arrests have created a stir across the country.

From MPs, MLAs to state chief ministers, many people have been arrested. Even before the start of 2024 Lok Sabha elections, Jharkhand Chief Minister Hemant Soran and Delhi Chief Minister Arvind Kejriwal were arrested by the enforcement department. All of them are pleading in court that the ED’s arrest was illegal. ED is feared.

In this case, the Supreme Court has issued an important order today (May 16). This gives some comfort to the political leaders, rulers and industrialists who are afraid of ED. This is the thing. The enforcement department has restricted arrests in illegal money transfer cases.

Permission of the Special Court

No one shall be arrested without the permission of a special court after the charge sheet has been filed. If the accused person wants to be taken into custody, the enforcement department has to file a petition in the concerned court. The special court will examine the reasons for the detention and decide on the petition of the enforcement department.

Illegal money transfer case

Should the enforcement department remand the accused in the case? Don’t you? A special court will decide on that. Through this, the person accused in the case of illegal money transfer can be taken for investigation and arrested. But no arrest can be made after filing a charge sheet. It seems that we have to appeal to the Special Court and wait for its order.

Bail is difficult, arrest is difficult

There is another thing to note. Once arrested by the enforcement department, it is very difficult to get bail. Similarly, it is seen that the Supreme Court has taken such a step with the intention that the arrest process should be very strict.
