5 judges to hear Karannagoda’s petition

38The five-judge Man Court of Appeal decided yesterday (07) to hear a writ petition filed by former Navy Commander Admiral of the Fleet Vasantha Karannagoda seeking an interim injunction to suspend the case against him in connection with the abduction and disappearance of 11 youths.

This decision has been announced after considering the request made by the Attorney General for hearing. This petition was taken up for hearing in the presence of President of the Court of Appeal Nishanka Bandula Karunaratne and Justice of the Court of Appeal Sashi Mahendran. The Deputy Solicitor General who appeared on behalf of the Attorney General told the court that it was taken up earlier in the presence of Justice Lafar Tahir of the Court of Appeal.

During this, the Deputy Solicitor General said that after considering the request for taking up the petition before a full bench, it was sent to the Chief Justice for decision.

3-Judge Bench of High Court case against Petitioner; He had requested the court to consider the petition before a bench of more than three judges as it is coming up for preliminary hearing.

Accordingly, it was decided to appoint a full bench of five judges to hear the petition. Accordingly, it was decided to take the petition into consideration on the 25th.

The Attorney General has been named as the defendant in the petition filed by the former Navy Commander seeking to suspend the trial of the case filed against him in the High Court regarding the abduction and disappearance of 11 youths in Colombo and its suburbs in 2008.

In this writ petition, the petitioner had requested that a notice should be sent to the respondents and also that the trial of the impeachment case should be suspended and an interim order should be issued.

On June 25 last year, the Court of Appeal issued an interim order suspending the trial of the charge sheet case against Navy Commander Admiral of the Fleet Vasantha Karnakoda, which was continued in the Colombo High Court in connection with the abduction, disappearance and murder of 11 youths. The then Court of Appeal Justice A. H. M. D. Nawaz and Justice Sobitha Rajakaruna passed the interim order.

The interim order will remain in force till the hearing of Vasantha Karnagoda’s petition filed by the Appellate Court to stay the trial.

The court allowed the interim petition filed by the parents of the missing children involved in the petition.
